Mr. Bernstein is a trial attorney and litigator. His areas
of experience include Real Estate related litigation with an
emphasis on the Construction Industry, and the Jewelry
Industry. He has represented owners and developers,
construction managers, general contractors and design
professionals in connection with prominent projects such as
the renovations of Grand Central Terminal and Rockefeller
Plaza.
Mr. Bernstein also serves as primary outside counsel to a
large jewelry manufacturer and wholesaler in which capacity
he coordinates a variety of legal services including
copyright, trademark and patent filings; UCC filings;
employment issues, including immigration issues; and a
variety of general corporate and litigation services. Mr.
Bernstein has represented clients in intellectual property
disputes, civil rights litigation and discrimination
actions.
Mr. Bernstein’s practice reflects his strengths in not only
litigating and resolving cases, but also in providing legal
counsel on a wide range of business issues and disputes. He
advises clients on such diverse matters as corporate
reorganizations, protection of intellectual property and
compliance with industry-specific regulatory provisions.
Mr. Bernstein served in an instrumental role in securing the
largest favorable settlement in a major telecommunications
provider's history, involving a multibillion-dollar dispute
related to the construction and ownership of an undersea
fiber optic cable network. He also aided a client – one of
the 20 largest architecture and engineering firms in the
United States – in taking advantage of capital markets
typically closed to professional firms, in connection with a
corporate reorganization. Mr. Bernstein has developed
protocols and prepared agreements to protect the
intellectual property of design and manufacturing clients in
order to preserve their competitive advantage.
Mr. Bernstein has represented numerous clients in
construction industry-related matters, including acting as
litigation counsel to a large international bank with
respect to a half-billion-dollar commercial dispute arising
out of the production of liquefied natural gas in Indonesia.
As lead counsel in an arbitration proceeding, he won an
award for an architectural firm related to claims of
professional malpractice that denied all claims and ordered
claimant to reimburse the client for incurred arbitration
fees. |
